1. Purpose and acceptance

These terms govern the use of Tennistiq, an online service for tracking tennis tournaments, matches and rankings. Creating an account or using the service constitutes acceptance.

The service is free during the beta: no terms of sale apply at this time. Separate terms will be drawn up and submitted for acceptance before any billing.

2. Publisher

The publisher's identity, company number and contact details are given in the legal notice.

3. Access to the service

Part of the service can be consulted without an account: the tournaments, draws, results, interclubs, clubs and player pages read from the federations' websites. Following a player, scoring a match live or receiving notifications requires an account.

Tennistiq is in private beta. Access is requested through the form on the home page; the publisher creates the account and sends an activation link by email, from which you choose your password.

Submitting a request does not grant any right of access. The publisher opens access in waves and may refuse a request without giving reasons.

4. Account

  • The account holder must be an adult.
  • The account is personal: sign-in details must not be shared.
  • The information provided must be accurate and kept up to date.
  • The publisher may refuse, suspend or close an account in the event of abuse, unlawful content or harm to the service.

5. Followed players and minors

The service is designed for an adult to follow the results of one or more players, very often their own children or the players they coach.

  • By following a minor, you warrant that you are their legal representative or have their consent and that of their legal representative.
  • A follow group is shared: all its accepted members see the same data. Only invite people who are entitled to see it.
  • Publishing a tournament recap creates a public page, accessible to anyone who has the link, and which remains so until you revoke it. It is a voluntary act whose consequences you accept — particularly when it concerns a child.
  • The same applies to the calendar feed address: it gives access to your group's calendar without a password.

6. Federation credentials

You may enter the AFTNET code of a player you follow so that the service can read their tournament entries. In doing so:

  • you declare that you are authorised to provide this code;
  • you accept that it is used exclusively for reading, to collect the entries of the player concerned;
  • the code is never used to enter, withdraw or change anything with the federation;
  • it is encrypted, never displayed again, and deleted when following ends;
  • access is cut off after three failed sign-in attempts, so as not to lock the player's federation account.

Details are set out in the privacy policy.

7. Acceptable use

It is prohibited:

  • to automate access to the service or extract its data in bulk;
  • to bypass authentication or access the data of another follow group;
  • to disrupt or overload the infrastructure;
  • to republish the service's data for commercial purposes;
  • to follow a person who objects to it, or to use the service to monitor someone;
  • to post unlawful or defamatory content, or content that infringes the privacy of a third party.

8. Intellectual property and licence

The publisher grants you a personal, non-exclusive, non-transferable and revocable right to use the service.

The data you enter remains yours. You grant the publisher the licence strictly necessary to host it, display it to the members of your follow group and perform the calculations you request. The publisher may use aggregated statistics that do not identify any person.

9. Availability, beta and changes

The service is provided as is, without any guarantee of availability or continuity. Being in beta, its features may change, be suspended or disappear. Synchronisations depend on third-party websites that may change without notice and interrupt the flow of data.

10. Accuracy of sports data

Points, projected rankings and positions in the pyramid are calculations and estimates, based on data published by the federations. Only the figures published by the federation are authoritative. They cannot be used to contest a federation decision.

Tennistiq is not affiliated with, endorsed by or a partner of any federation.

11. Liability

The publisher's liability is limited to direct and foreseeable damage, up to the amounts you have actually paid over the previous twelve months. As the service is currently free, this amount is zero. Indirect damage is excluded, in particular loss of data, of chance or of sporting opportunity.

None of these limitations apply in the event of fraud, gross negligence, or harm to a person's life or physical integrity; nor where the law prohibits them, in particular for the benefit of consumers.

12. Free service and pricing changes

The service is free at this time. Any paid offer will be subject to separate terms, accepted separately. No payment will ever be taken without your express consent.

13. Suspension and termination

You may ask for your account to be closed at any time by writing to info@tennistiq.be. The publisher may suspend an account after a formal notice that goes unheeded, or immediately in the event of serious harm to the service or to the rights of a third party.

The consequences for your data are described in section 10 of the privacy policy: some data also concerns other people and does not disappear with your account.

14. Personal data

The processing of personal data is described in the privacy policy, which forms an integral part of these terms.

15. Changes to the terms

These terms may be amended. Any substantial change is announced by email before it takes effect. Continued use constitutes acceptance; otherwise, you may close your account.

16. Governing law and disputes

These terms are governed by Belgian law. In the event of a dispute, an amicable solution will be sought first; a consumer may refer the matter to the Consumer Mediation Service. Failing that, the Belgian courts have jurisdiction, without prejudice to the mandatory rules protecting consumers, who retain the right to bring proceedings before the courts of their place of residence.
